These Terms of Service (“Terms”) govern your access to and use of the Backstory Prints website, services, production, fulfillment, and related offerings.

By placing an order, uploading artwork, creating an account, or using our services, you agree to these Terms.

1. Overview

Backstory Prints provides print-on-demand, apparel printing, fulfillment, production, and related services for businesses, brands, creators, and individuals.

We reserve the right to update, modify, or discontinue any service at any time without prior notice.

2. Eligibility

By using our services, you confirm that:

  • You are at least 18 years old or legally authorized to enter into agreements
  • All information provided is accurate and current
  • You have the legal authority to use submitted artwork, logos, and content

3. Orders & Production

All orders are subject to acceptance and production availability.

Production timelines provided by Backstory Prints are estimates only and may vary based on:

  • Order volume
  • Garment availability
  • Equipment maintenance
  • Shipping carrier delays
  • Holidays or force majeure events

We reserve the right to refuse or cancel orders at our discretion.

4. Artwork Requirements

Customers are responsible for ensuring all submitted artwork:

  • Is print-ready
  • Meets required specifications
  • Is free from spelling or design errors
  • Has proper licensing or ownership rights

Backstory Prints is not responsible for:

  • Low-resolution artwork
  • Design placement issues caused by supplied files
  • Typographical errors submitted by customers
  • Color differences between screens and printed products

Minor variations in print placement, garment shade, sizing, or color are considered normal production tolerances.

5. Intellectual Property

Customers retain ownership of their submitted artwork and intellectual property.

By submitting artwork or content, you grant Backstory Prints a limited license to use the materials solely for:

  • Production
  • Fulfillment
  • Proofing
  • Customer support

You confirm that you own or have permission to use all uploaded content.

Backstory Prints reserves the right to reject any content that:

  • Violates intellectual property rights
  • Contains unlawful material
  • Includes hate speech, explicit content, or prohibited material
  • Violates applicable laws or regulations

6. Customer & Business Confidentiality

Backstory Prints respects the confidentiality of customer and business information.

Any customer lists, order information, store data, uploaded artwork, shipping information, or proprietary business materials shared with us will only be used for:

  • Production
  • Fulfillment
  • Operational support
  • Customer service

We do not sell, distribute, or use client customer information for marketing or solicitation purposes.

We will not contact or market directly to our clients’ customers or end users.

7. Pricing & Payments

All pricing is subject to change without notice.

Payment is required before production begins unless otherwise agreed in writing.

Customers are responsible for:

  • Applicable taxes
  • Duties and customs fees
  • Accurate billing information

Failure to complete payment may result in order delays or cancellation.

8. Shipping & Fulfillment

Shipping timelines are estimates only and are not guaranteed.

Backstory Prints is not responsible for delays caused by:

  • Shipping carriers
  • Customs processing
  • Weather events
  • Incorrect shipping addresses provided by customers

Customers are responsible for verifying shipping details before order submission.

Risk of loss transfers to the customer once the order has been transferred to the shipping carrier.

9. Returns, Refunds & Reprints

Due to the custom nature of printed products, all sales are generally final.

Refunds, replacements, or reprints may be issued solely at Backstory Prints’ discretion in cases involving:

  • Misprints
  • Damaged items
  • Incorrect products caused by production error

Claims must be submitted within 7 days of delivery and include supporting photos where applicable.

We do not offer refunds or reprints for:

  • Buyer’s remorse
  • Incorrect sizing selected by customer
  • Minor color variation
  • Delays caused by carriers
  • Customer-submitted artwork errors

10. Chargebacks & Payment Disputes

Customers agree to contact Backstory Prints directly to resolve any issues before initiating chargebacks or payment disputes.

Fraudulent or abusive chargebacks may result in:

  • Account suspension
  • Refusal of future service
  • Collection activity where permitted by law

11. Limitation of Liability

To the maximum extent permitted by law, Backstory Prints shall not be liable for:

  • Indirect or consequential damages
  • Lost profits or business interruption
  • Delayed shipments
  • Third-party carrier issues
  • Data loss
  • Unauthorized access to customer accounts

Our total liability shall not exceed the amount paid for the affected order or service.

12. Indemnification

You agree to indemnify and hold harmless Backstory Prints and its affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Submitted artwork or content
  • Intellectual property infringement
  • Misuse of our services
  • Violation of these Terms

13. Account Usage

Customers are responsible for maintaining the confidentiality of account credentials.

Backstory Prints is not responsible for unauthorized account access caused by customer negligence.

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse staff or systems
  • Submit prohibited content

14. Website Usage

You agree not to:

  • Attempt to disrupt website functionality
  • Access unauthorized systems or data
  • Use automated scraping tools
  • Upload malicious software or code

Unauthorized use may result in legal action.

15. Third-Party Services

Our website and operations may integrate with third-party platforms, apps, or providers.

Backstory Prints is not responsible for third-party services, outages, policies, or actions.

16. Force Majeure

Backstory Prints shall not be held liable for delays or failure to perform caused by events beyond our reasonable control, including:

  • Internet or hosting failures

17. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of California, United States.
